Due to shift in county lines, some documents re Garrett Morris are found in Lee CO., AL.] Will of Garrett Morris 1792-1875 The State of Alabama I, Garrett Morris, a citizen of formerly County of Lee Chambers County, knowing the uncertainty of life, and the certainty of death, being in sound mind, and uninfluenced by any one, do hereby make and declare this to be my last Will and Testament. Having heretofore given to my sons A. J. Morris property to the amount of six hundred and twenty four dollars and fifty cents, to William H. Morris six hundred and twenty four dollars and fifty cents, to my (son in law) Kinchen M. Reddick six hundred and twenty four dollars and fifty cents, to my son John Morris, five hundred and sixty dollars and fifty cents, to my son Samuel C. Morris, four hundred and eighty seven dollars aznd fifty cents, to my son James C. Morris, four hundred and eighty seven dollars and fifty cents, to my (son-in-law) R. M. Templeton, four hundred and fifteen dollars, to my (son in law) E. P. Horton four hundred and twenty seven dollars,m and to my son L. G. Morris One hundred and seventy seven dollars it is my will to dispose of the balance of my property as follows: First- I will to my beloved wife Lavonia and my children Emma Frances, Mary Lewis and Benjamin Franklin, that piece of my land known as my homestead, being the northwest qauarter of section sixteen, township twenty, and range twenty six, also twenty acres heretofore purchased by me of Wm F. Samford, and fifteen acres purchased by me of Joe H. Harris both adjoining said quarter section and making in the aggregate, one hundred and ninety five acres, said described lands to be appraised by three disinterested persons, and the value thereof to be charged to my wife Lavonia and children Emma Frances, Mary Lewis and Benjamin Franklin to be accounted for in general settlement of my estate- 2nd- It is my will that my wife Lavonia and children Emma Frances, Mary Lewis and Benjamin Franklin live together and have the proceeds of said lands in common until the youngest one Mary Lewis becomes of age when it is my will that said lands shall be equitably divided between them or should my wife Lavonia marry before the youngest one to wit Mary Lewis become of age then it is my will that said lands and the proceeds shall be equally divided between them- 3rd- I will to my wife Lavonia and children Emma Frances, Mary Lewis and Benjamin Franklin all my household and kitchen furniture to be use in common and divided between them as the land- 4th- I will to my son Benjamin Franklin one horse worth sixty five dollars in gold, and one saddle, worth ten dollars in gold, and I also will to him my silver watch, one cow and calf and one sow and pigs- 5th- I will to my tow daughters Emma Frances and Mary Lewis, one cow and calf and one sow and pigs each. 6th- I will to my wife Lavonia one cow and calf and one sow and pigs, and one horse worth sixty five dollars- 7th- It is my will that the cows and calves and sows and pigs which I have heretofore willed to my wife and children, Emma Frances, Mary Lewis, and Benjamin Franklin be charged to them at the following prices to wit: the cows and calves at fifteen dollars each, and a sow and pigs at seven dollars to accounted for in a final settlement of my estate- 8th- It is my will that the horses willed by me to my wife Lavonia and son Benjamin Franklin be charged to them and accounted for in the final settlement of my estate. 9th- It is my will that my wife Lavonia and children Emma Frances, Mary Lewis and Benjamin Franklin have set apart and be furnished with enough provisions for their use one year, and not to be charged to them in the general division of my estate- 9th- (sic) I will to my wife Lavonia and children Emma Frances, Mary Lewis and Benjamin Franklin, three hundred dollars in specie, to be used for the purpose of their education, that is, to purchase school books and pay their tuition jointly and equally. 10th- It is my will, that the remainder of my Estate, not willed away or enumerated above, shall be sold and equitably divided between my wife Lavonia and my heirs, the children of my body, so that each one shall share an equal part, including the amounts heretofore given them, excepting however, the three hundred dollars willed to my children Emma Frances, Mary Lewis and Benjamin Franklin set apart for their education and my silver watch, willed to my son Benjamin Franklin, and one years provisions for the use of my wife Lavonia, and children Emma Frances and Benjamin Franklin, and Mary Lewis. 11th- I hereby will and appoint my wife Lavonia Morris, and my son A. J. Morris, Executors of this, my last will and testament- Witness my hand and seal, this 11th day of March A.D. 1867 Signed in presence of Joe H. Harris Garret Morris Jas. A. Allen, The State of Alabama In Probate Court Lee County September 6th 1875 In open Court personally appeared James A. Allen, a subscribing witness to the foregoing will who after being duly sworn said that Garrett Morris the Testator therein voluntarily executed the same and declared the same to be and contain his last Will and Testament in his presence and in the presence of the others subscribing witness on the day of the same bears date, that he subscribed his name as a witness in the presence of said Testator and of the other witness, and that such other witness subscribed his name as a witness in his and the Testator's presence, and that in his opinion and belief said Garret Morris at the time of executing said will....
