Sumter County, Alabama Deed Book A, p. 492 October 14th 1835 State of Alabama County of Sumter Town of Gainesville Be it remembered that on the 5th day of August AD 1835 Thomas Ware and Charles Buchanan both of said county, personally appeared before me Christopher C. Scott notary public commissioned by his excellency the Governor of the State of Alabama duly qualified and sworn according to the laws of the State of Alabama and dwelling in the Town of Gainesville aforesaid, And upon oath administered to them by me-deposed and said that they these affiants have for a number of years last past lived at or near then present resided within the boundary of the Country ceded to the United States by the Choctaw Indians at Treaty of the Dancing Rabbit Creek-that during all said time they these affiants have been well acquainted with Alcy Tom, a Black female born in said Choctaw Nation that-- said Alcy is the fourth daughter of Old Tom and Sally born after Old Toms freedom and after he had purchased his wife Old Sally and that said Alcy is a full sister to Moses and Jack Tom and Mary Tom that during the time that these affiants have known the said Alcey Tom that she the said Alcey Tom has had born of her the following named children to wit--Caroline Tom born 7th day of March 1827 and Cl??? Tom born June 13th AD 1832 the first of whom is daughter and the said last is a son both of whom are both very dark nearly black there [sic] Father William Lightfoot having been a son old Free? Black Jim by a full Blooded Choctaw which made the children very dark as aforesaid Further they say not Thomas Ware Sworn and subscribed before Charles Buchanan me in my office in the Town of Gainesville aforesaid on the day & Year aforesaid In testimonium veritates [sic] I have to these presents set my signature and affixed my notarial Seal of office Christ C. Scott notary public Although the undersigned cannot upon there personal knowledge testify as to the truth of the within affidvits [sic]. Nevertheless from circumstances within there knowledge they have no hesitation here to certify that from facts and circumstances within there knowledge they do believe the facts set forth here in said affidavits to be strictly true.
