Sumter County, Alabama Deed Book D, p. 650 Jack Tom To Robert Boyett Recd & Recorded the 24th December 1838 This Indenture made the twenty third day of November in the year of our Lord one thousand eight hundred and thirty six between Jack Tom of the County of Sumter & State of Alabama of the first part and Robert Boyett of the County of Sumter & State aforesaid of the Second part. Witnesseth that the said party of the first part for and in consideration of the sum of twelve hundred forty five dollars and cents to him in hand paid by the said party of the Second part the receipt whereof is hereby acknowledged hath bargained and sold and by these presents doth bargain and sell unto the Said party of the Second part and his heirs and assigns for ever the following piece or parcel of land situate lying and being in the County of Sumter & State of Alabama in the land district of Tuscaloosa designated and known upon the United State plats of survey as the South East quarter of Section No thirty five Township No twenty one of Range Two West containing one hundred and sixty six 69/100 acres together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the resisions and revisions remainders and remainders rents issues and profits thereof and also all the Estate right title interest claim or demand whatever of him the party of the first part either in law or equity of in and to the above bargained premises and every part and parcel thereof to have and to hold to the said party of the Second part his heirs and assigns to the law and only purposes benefit and behoof of the said party of the second part his heirs and assigns forever and the Said party of the first part for himself heirs executors and administrators doth hereby warrant and will forever defend the title of the above bargained premises to the said Robert Boyett party of the second part his heirs and assigns free from the claim or claims of all and every person or persons whatsoever ? from the claims of the General Government. In testimony whereof the party of the first part has to these presents set his hand and affixed his seal the day and year first above written Jack Tom {seal} Know all men by these presents that I Oula to na Tom the wife of Jack Tom the grantor in the within deed of conveyance for the consideration of one dollar to me in hand paid by the said Robert Boyett the receipt whereof is hereby acknowledged have granted bargained and sold remized released and forever quit claimed and by these presents do grant bargain & sell convey remize release and forever quit claim unto him the said Robert Boyett and unto his heirs and assigns forever all claim interest Dower or right or title of Dower which I now have or ever hereafter may have unto or out of parcel of land or the appurtenances thereof in the foregoing deed of conveyance ????? and des???? In Testimony whereof I the said Oulatona Tom have hereunto subscribed my name and affixed my seal the 23 day of November 1836 Oulatona Tom {seal} her mark The State of Alabama Sumter County Be it remembered that on the 23rd day of November in the year of our lord one Thousand eight hundred and thirty six the within named Jack Tom personally appeared before me William J. Steele an acting Justice of the peace in & for the county & state aforesaid and acknowledged that he signed sealed and delivered the within deed on the day and year therein mentioned to the within named Robert Boyett also in like manner appeared Oulatona Tom and Indian woman of the Choctaw tribe the wife & consort of the within named Jack Tom who by means Cyrus? Tom an interpreter of the Choctaw language by me sworn acknowledged and declared after having been by me by means of said interpreter examined separate and apart from her said husband that she signed sealed and delivered the foregoing relinquishment freely and of her own accord without any threats or coercion from or on the part of her said husband the said Jack.
