Sumter County, Alabama Deed Book A, p. 490 October 14th 1835 State of Alabama County of Sumter town of Gainesville Be it remembered that on the fifth day of August AD 1835 Thomas Ware and Charles Buchanon both of said county person- ally appeared before me Christopher C. Scott Notary Public commissioned by his excellency the governor of the State of Alabama and duly qualified and sworn according to the laws of the state of Alabama and dwelling in the town of Gainesville aforesaid and upon oath duly administered to them by me depo- sed and said that these affiants have for a number of years last past lived at their present residences in within the boundary of the county ceded to the United States by the Choctaw Indians by the treaty of Dancing Rabbit creek that during ///// all said time they have been well acquainted with Mary Tom a black female born in said Choctaw nation That said Mary is the third daughter of old Tom and old Sally born after old Tom?s freedom and after he had purchased his wife old Sally & that said Mary is a full sister to Moses and Jack Tom that since these affiants have been acquainted with the said Mary that she the said Mary has been born of her the following named children To wit. Emily Y. Ware bone on the 23rd January 1829 Arianah Tom born June 20th 1831 Pernell Tom born March 6th 1833 and George S. Gains Tom born November 10th 1834 The two first of whom are females the two last males Further these affiants say not Thomas Ware Sworn to and subscribed Charles Buchanon before me in my office in the town of Gainesville aforesaid on the day and year above written In Testimonium Veritates [sic] I have hereunto set my signature and affixed my Notarial seal of office Christopher C.
