Sumter County, Alabama Deed Book A, p. 491 October 14th 1835 State of Alabama County of Sumter Town of Gainesville Be it remembered that on the fifth day of August AD 1835 Thomas Ware and Charles Buchanon both of said county personally appeared before me Christopher C. Scott Notary Public duly commissioned by the governor of the State of Alabama duly qualified and sworn according to law and dwelling in the town of Gainesville aforesaid and upon oath deposed and said that they these affiants both residence within the late Choctaw country ced-ed to the United States by the treaty of Dancing Rabbit Creek made the 27th of September AD 1830 for a number of years before said treaty; that during all said period they have been well acquainted with Moses Tom That said Moses Tom is the first son of old Tom and old Sally his wife both of whom were blacks old Tom purchased his own freedom from old Ben James a white man who had a Choctaw wife and lived and died in the Choctaw nation and old Tom after having also purchased his wife from the said Ben James she the said Sally was emancipated at his death by his the said old Toms last will and testament That when these affiants became [acquainted] with the said Moses Tom he the said Moses was married to a choctaw full blood called ?Ohoyo? and he has ever since to the present time lived with lived with the said ?Ohoyo? and had had by the said full blood choc-taw woman ?Ohoyo? the following named children all of whom are now living with him on Toms Creek in about five miles of the town of Gainesville aforesaid. To wit Rebeca Tom born 10th day June 1816 Lizas [?] Tom born 5th March 1820 Watt Tom born 1st January 1822 Solomon Tom born 28th February 1826 Bynon ? Tom born June 20th 1828 Amos Tom born 1st day of March 1830 Saint Clair (or Sing Clear) Tom born 2nd February 1832 and Letty Tom July 21st 1834 The first and last named being females the others male children?further these affiants say not Sworn to and subscribed Thomas Ware before me in my office Charles Buchanon Ton Gainesville aforesaid This day and year above written In testimonium veritates [sic] I have set my signature and affixed my Notarial seal of office Christopher C.
