The State of Alabama Sumter County

This Indenture made this day of November in the year of our Lord one thousand Eight Hundred and sixty six between John H Gary and his wife Eliza Gary of the first part, and Abner R. Scarborough of the second part all of the County of Sumter and State of Alabama. Witnesseth;

That the second parties of the first part, for and in consideration of the sum of Seven Thousand Dollars to them in hand paid by the Said party of the second part, the receipt whereof is hereby acknowledged, have this day granted bargained and sold, and by these presents do grant bargain, sell, convey and confirm unto the said party of the second part, all and singular, that certain piece or parcel of land Situated in the County and State aforesaid and in the District of Land subject to sale at Demopolis designated and known as: W ½ of the NW ¼ of Section Thirty (Monette): also the S ½ of Section Nineteen (Tucker): also the S ½ of the NE ¼ of Sec Nineteen; also all that part of the NW ¼ of the NE ¼ of Sec Nineteen lying East of Jones Bluff and Demopolis Road; also the SW ¼ of Section Twenty; also the W ½ of the SE ¼ of Sec Twenty also the W ½ of the E ½ of the S.E. ¼ of Sec Twenty; also the S ½ of the SW ¼ of Section Twenty; also NE ¼ of the NW ¼ of section Twenty; also Eight (8) acres off the S’ End of the SW ¼ of the NE ¼ of Section Twenty; also the NE ¼ of the NW ¼ of Section Twenty Nine; also the NE ¼ of the NW ¼ of Section Twenty one; also the NW ¼ of the NE ¼ of Section Twenty one; also the W ½ of the SE ¼ of Section Sixteen; also the SE ¼ of the SW ¼ of Sec Sixteen, Containing Eleven Hundred and Twenty eight acres more or less all in Township Nineteen, Range 1 West; also the free and uninterrupted right of way over the NW ¼ of the NW ¼ of Section Twenty-one and the SE ¼ of the NE ¼ of Section Twenty in Township and Range aforesaid; the right of way to be determined by the road that now runs from my dwelling over said lands to my River plantation on the Bigbee River; together with all and singular the tenements, heredetaments and appurtenances and all the estate, title, interest, and right of dower of the Said parties of the first part thereon.

And the said parties of the first part do hereby covenant and agree with the said party of the second part, that; at the time of the delivery hereof the said party of the second part is the lawful owner of the premises above granted, and seized thereof fee Simple absolutely, and further that they will warrant and defend the above granted premises, in the quiet and peaceablepossession of the said party of the second part.

In witness Whereof we have hereunto affixed our hands and seals on the 26th day of November in the year of our Lord One thousand Eight Hundred and sixty six.

Gould an acting Justice of the Peace in and for the County and State aforesaid do hereby certify that John H Gary and his Wife Eliza Gary whose names appear to the foregoing conveyance, did, on being informed of the contents of said conveyance execute the same voluntarily on date therewith Given under my hand and seal this 26th day of November in the year of our Lord one thousand eight hundred and sixty Six.
