Sumter County, Alabama Deed Book B, p. 73 This Indenture made and entered into the sixth day of July in the Year of our Lord one thousand eight hundred and thirty six between Ohoyo Tom and Moses Tom her husband of the first part and Sally Tom of Sumpter County of the Second part. Witnesseth that the said party of the first for and in consideration of the sum of Eight Hundred Dollars to them paid in hand by the said party of the second part?the receipt whereof is hereby acknowledged?hath bargained and sold by these presents doth bargain and sell unto the said party of the second part and to her heirs and assigns forever. Two hundred and twenty acres of Land to be laid off from the Northern part of Fractional Section number thirty two in Township Twenty one of Range Number one West in the Land district of Tuscaloosa Alabama. Said two Hundred and twenty acres to be laid off in as compact a form as possible and in include the personal residence of said Sally Tom. The Said tract of Land hereby granted being a portion of the tract of Land acquired by Ohoro Tom under the 14th article of the Treaty of Dancing Rabbit Creek. Together with all and singular, the hereditaments and appurtenances thereunto belonging or in any wise appertaining: and the revisions and revisions remainder and remainders , rents, issures , and profits thereof; and also all the estate, right , title, interest claim or demand whatever of them the said party of the first part either in Law or equity, of, in, to, the above premises; and every part and parcel thereof To have and to hold, to the said party of the second part her heirs and assigns, to the sole and only proper use, benefit, and behoof of the said party of the second part her heirs and assigns forever. And the said party of the first, for themselves heirs, executors and administrators doth hereby warrant, and will forever defend the title of the above bargained premises to the aforesaid Sally Tom and to her heirs and assigns, free from the claim or claims of all and every person or persons whatsoever as also from the claims of the General Government. In Testimony whereof the parties of the first part have to these presents set their hands and affixed their seals the day and year first above written. Scott The State of Alabama Sumpter County Be it remembered that on the 6th July AD 1836 the within named Moses Tom personally appeared before me Christopher C. Scott Notary Publick duly commissioned and qualified according to law, and dwelling in the Town of Gaines-ville aforesaid and acknowledged that he signed sealed and delivered the within on the day and year therein mentioned to the within named Sally Tom?also in like manner appeared the within named Ohoye Tom the wife and consort of the said Moses Tom?who being examined by me, privately and separately and apart from her said husband ?acknowledged and declared that she signed, sealed and delivered the within Deed freely and of her own accord and without any threat or compulsion on the part of her husband.
