Last Will and Testament of}              The State of Alabama
Stephen Horton, Dec'd}                   Sumter County
Probated November 16th, 1888. }        In the name of God, Amen
Recorded November 16th, 1888.}         I, Steven Horton of said
County, being sound of body and mind, do make publish and declare this to be my last will and testament, hereby revoking all others, by me previously made;-

I nominate and appoint my Grandsons, T. C. Speed, and J. B. Speed to be the Executors of my last will & testament, and moreover I do not require or desire them to give any Bond as such Executors, and I hereby and herein empower them to transact all business pertaining to my Estate, and to make a final settlement with all the other heirs in accordance with the following provisions of this my last will and testament without any legal interventure of any Court whatever-- --

I direct that all my personal property, and house-hold furniture, except a certain feather-bed & mattress two pillows & one bolster, which I reserve and bequeath to Aline Emily Johnston, the balance all to be Sold to pay my just debts, and to pay my burial expenses, and erect a tomb over my grave, and my wife, provided I have not had that done while I am living, and if there should be any money left after paying my just debts and defraying the above expenses, I desire and direct that it be equally divided between my daughter Mary E. A. White, Ada V. Tutt and Annie Flowers & Marshal H. Caldwell my Grand-children-

Second - I give and bequeath to my daughter Mary E. A. White and her heirs, the South half of Section three Town 18 R 1 E. and Sixty Acres of the North East quarter, and fifty acres of the East half of the North West quarter Section three Township eighteen Range one East lying South of the Belmont and Livingston road.

Third- I give and bequeath to my Grandson Marshal H. Caldwell and his heirs, one hundred and Sixty acres in the south West quarter of Section two Township eighteen Range one East.

Fourth- I give and bequeath to my Grand-daughter Ada V. Tutt and her heirs, Seventy-seven and a half acres in the West half of the North East quarter, and Eighty acres in the East half of the North west quarter, and forty acres of the West half of the North West quarter in Section Eleven Township eighteen Range one east.

Fifth- I give and bequeath to my Grand-daughter Annie Flowers and her heirs, forty acres of the North West quarter of Section eleven Township eighteen Range one East, and one hundred and Sixty acres of the North East quarter of Section ten Township eighteen Range one East.

Signed, sealed, published & declared by said Steven Horton to be his last will and testament in our presence; who at his request, and in his presence & in presence of each other, subscribe our names as witnesses, this 24th day of September 1886.
