"In the name of God Amen, I, Thomas Smithson of Baltimore County being very
weak in body but of perfect mind and Memory thanks be given to God for itt but
calling to mind that all Men are appointed to die do make and ordaine this my
last Will and Testament in manner and form following &c Item. I leave unto
my loving wife Ann Smithson all my Estate both Reall and personall during her
naturall life provided she make no wast of the Timber growing on the land and
further my will is that after my wifes decease that my land be equilly devided
between my Two sons Thomas Smithson and Daniell Smithson to them and thare heirs
and assigns forever and that all my personall Estate be equilly devided between
my two Sons aforesaid and my Two youngest daughters namly Sarah Smithson and
Avarilla Smithson after thare Mothers decease and further my will is that none
of my four daughters that are now Marry'd shall ever have any part of my Estate
more than what I have already given them Viz: my!
daughter Elianor wife of Samuell Durham, my daughter Rebecca wife of Samuell
Wilson, my daughter Rachell wife of Henry Donahue, my daughter Elizabeth wife of
Robert Clarke) forasmuch as I have given them all that I intend to give them in
my lifetime. Ratifying and confirming this my last Will and Testament as Witness
my hand and Seale this Eleventh day of August 1731.
