Ephraim Burnside Will
I, Ephraim Burnside of the town of Maryland County of Otsego and
State of New York considering the uncertainty of this life and being
now of sound mind and memory do make publish and declare this my last
Will and Testament in manner following viz. 1st I give and bequeath to my daughter Betsey the sum of One
thousand dollars. 2nd To my daughter Nancy Eight hundred dollars 3rd To my son DeWitt three hundred dollars 4th To my sons Daniel and William each one hundred dollars 5th To my daughters Polly and Sally each three hundred and
fifty dollars 6th If there should be and remain any overplies after paying
all my just debts and the forementioned legacies said overplies is to
be divided equally between my son DeWitt and my daughters Polly and
Sally share and share alike. And my executors are directed to sell and despose of all my
estate both real and personal in such way and at such time as shall
in their judgement be most for the advantage of all concerned. And I hereby make ordain and appoint Archibald Groff and John
Drake Executors of this my last Will and testament hereby revoking
all former wills by me at any time heretofore made. In Witness whereof I the said Ephraim Burnside have hereunto
set my hand and seal this second day of April 1858. his Ephraim X Burnside mark Signed, Sealed, published and declared by the said Ephraim Burnside
as and for his last Will & Testament in the presence of us who have
hereunto subscribed our names Witnesses to the same in the presence
of said at the request of the said Testator and in the presence of

Ephraim Burnside, late of the County of Otsego, deceased, (being the
foregoing written instrument) was duly proved before Thomas McIntosh
Jr. Surrogate of the said county, according to law, as and for the
last Will and Testament of the real and personal estate of the said
deceased; which said last Will and Testament and the proofs and
examinations taken there no recorded in this office. In testimony where of the surrogate
of the said county, hath hereunto set his (seal) hand and affixed his seal of office this 10th day of August A.D. 1838. (signed) Thomas McIntosh Jr. Surrogate.
