County of Burleson
Know all men by these present that I A. J. Berry, of Williamson
County and State aforesaid, surviving husband of Rhoda Berry dec'd for and in
consideration of four hundred and seventy four dollars, cash in hand to me paid
by Joseph Allbritton of the County first aforesaid, the receipt whereof is
hereby acknowledged, have this day granted, bargained and sold and by these
present do grant Allbritton a certain tract or parcel of land, lying in said
County of Burleson, being, a portion of Lot No 6 out of the Bradford
Hughes survey which lot was allotted and and set apart to said Rhoda Berry dec'd
in the partition of the estate of said Bradford Hughes dec'd the tract herein
conveyed being described by metes and bounds as follows to wit. Beginning
at the South corner of the Bradford Hughes survey; Thence N 45 E 1497 yards to a
corner to be established in the S.E. boundary line of said survey; Thence
N 45 W 1048 yards to the South corner of Lot No. 3; Thence N 45 W
738 yards to the East corner of Lot No. 5; Thence S 45 W 1497 yards to a
corner in the S. W. boundary line of said Bradford Hughes survey being the South
corner of lot No. 5; thence S 45 E. 1787 yards to the place of beginning,
containing four hundred an seventy four acres together with all and singular the
rights, privilages and
appurtenances thereunto belonging or in any wise incident or appertaining.
To have and to hold unto him the said Joseph
R. Allbritton his heirs or assigns in fee simple forever. and I do hereby
bind myself, my heirs and legal representatives to warrant and forever defend
the title to said tract of land unto him the said Joseph R. Allbritton, his
heirs or assigns against the claim or claims f any and all persons whomsoever
lawfully claiming or to claim the same or any part thereof. I furthermore
covenant, promise and bind myself in the sum of one thousand dollars to said
Joseph R. Allbritton that I will _______ the two oldest children of myself and
my deceased wife, within a reasonable time, and the remaining six of said
children, as soon as they respectfully arrive at full age, to execute,
acknowledge and deliver unto said Joseph R. Allbritton instruments in writing
releasing and relinquishing unto him all their right and interest in and to said
land. This deed is executed in lieu of the instruments in Writing
heretofore executed and delivered by me to said Joseph R. Allbritton and
recorded in the Land Registry of Burleson County in Book II on Pages 474 & 475.
The testimony whereof I hereunto set my hand at Caldwell, in said County of
Burleson on this the 24th day of March A. D. 1870

County of Burleson Before me a. H. Foster, Clerk of the
County court within and for said County an State this day personally appeared a.
J. berry, to me well known as the person he represents himself to be and
acknowledged that he had executed and delivered the above and foregoing
instrument in writing to Joseph R. Allbritton dated on the 24th day of March A.
D. 1870 for all the purposes and consideration therein set forth and expressed.
By Testimony where of & hereunto set my hand and the Seal of the county Court of
Burleson County, at th office in the town of Caldwell on this the 25th day of
March, A. D. 1870.
