MINYARD FAMILY

Submitted by Darryl Andrews, Livingston Louisiana at dga99@i-55.com on February 6, 2006

=====================================================================

The following family history is a chapter in a book which I am compiling and writing on the EDWARDS family who came to Livingston Parish, Louisiana about 1845. It is a work in process and the information is subject to corrections and additions as more information becomes available. The information was compiled from many sources, some from the internet, and at this point its correctness or accuracy can not be assured. THE INFORMATION IS UNPROVEN. It is intended solely as a starting point and therefore it is strongly recommended that anyone using the information should do their own further research to the extent that they are satisfied with the information. As anyone doing genealogy research knows, it is very difficult to find “proof” of the accuracy of information. Indeed many times even the person providing the direct information or the person recording it has gotten it wrong and some legally recorded records themselves have been shone to be less than accurate. People can have an honest disagreement about any information used and therefore each should determine for themselves how satisfied they are in using the information. If someone used only information from which there was a definitive “proof”, then each family history would be very short indeed.

JAMES MINYARD, SR. was born about 1765-1768 in Moore County, North Carolina and died about 1827 in Lawrence County, Mississippi. Research at this time has not determined his actual birthplace and date nor his marriage and the names of his wife and parents although some records suggest that he was married in 1788 in North Carolina. James Minyard was part of the “Nathan Smith Settlement” in Franklin County, Georgia and owned land along Mountain Creek. He was one of the signers of a letter to Governor James Jackson of GA dated 1798 from Franklin County, GA. The letter was signed by 46 residents of Jackson and Franklin Counties seeking relief from Indian infringement on land that was deeded to them by the State of Georgia between 1783 and 1788. As a matter of fact, the spelling was James MINNERD on the document. Many of the “Nathan Smith Settlers” can be traced to Cumberland, Moore, and Anson County area of North Carolina.

He left Franklin County, Georgia. due to problems associated with boundary disputes related to the Indian Nations land. He was in Bogue Chitto area of Lawrence County, Mississippi by or before 1812. The Smith's, Carpenter's, Dickerson's, Guess, Kees, Minyard and Walker families plus many others, served in the War of 1812 in the Capt. Billy Smith's Regiment. The men were organized and went back to Alabama to fight the Creeks at Fort Mim's in 1813.

James Minyard appears on the Lawrence County, Mississippi tax list as early as 1816 and he owned land along the Bogue Chitto River which he acquired in 1820 by a US Land Patent issued  by President James Monroe for 300.92 acres in Lawrence County, Mississippi. He died in Lawrence County in 1827. In 1833 his sons James, Jr., William and Thomas moved into Carroll County, Mississippi. His remaining son John went to Copiah County, Mississippi with his sister Elizabeth Minyard Case and her husband Thomas.

Tax Rolls 1818 and 1825.  1825 Tax Roll (page 109)

1828 Tax Roll of Lawrence County, Mississippi:

William Minyard, 160 acres on Bogue Chitto, 2 slaves, 1 poll

James Minyard, Bogue Chitto, 1 poll

John Minyard, Bogue Chitto, 1 poll

The poll tax was an assessment on all free white males between the ages of 21 and 50.  Younger men who had reached age 21 but were not yet financially established and owned no taxable property were assessed only the poll tax.  As they became older many eventually acquired land and/or slaves and at that time would be assessed the appropriate property tax.  Of course, many men never acquired land or slaves and thus were assessed only a poll tax throughout their life.  It is also common for a father to be assessed tax on land and slaves and his younger sons perhaps to be assessed only a poll tax.  When someone was taxed for land and/or slaves but were not assessed a poll tax, that is an indication that they were over 50 years old.  Women were not taxed at all unless they were the head of household and owned land or slaves.  The poll tax was not

assessed on women. (*Provided by Greg Price, Dallas, TX <GregoryPrice62@aol.com>*)

He was born about 1793-1795 in the Orangeburgh District of South Carolina. In 1810 he moved with his parents and other family members into Mississippi where they settled in Lawrence County in the area around Brookhaven. He served in the War of 1812 in the Mississippi Militia in Capt. Peter Barnett's Company, in the battalion commanded by Lt. Col. Peter Perkins. He was the progenitor of the EDWARDS family line in Livingston Parish. He and Celia's early years in the parish were spent cutting trees to clear the land for crops and to build a home to protect their large family. Celia died in February 1865 and Clarkston was married shortly thereafter to ROSA MARY HOWZE, born April 14,1814, the widow of AMERICUS VESPUSIUS "BRUCE" BENNETT.
